GuideMind Terms of Use v1.0

1. Agreement

These Terms of Use ("Terms") govern your use of the GuideMind application and related services (the "Service") provided by Softina ("Company", "we", "us").

By selecting "I Agree" in the app clickwrap, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least the age required by applicable law in your jurisdiction to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

3. Nature of the Service

GuideMind provides AI-generated informational guides for devices/items based on user-provided inputs (photos/text).

The Service is informational only and does not constitute professional, technical, engineering, electrical, mechanical, medical, legal, or safety advice.

4. Safety and Assumption of Risk

AI-generated guides may be incomplete, outdated, or inaccurate.

You are solely responsible for:

• verifying instructions against official manufacturer documentation,
• following safety labels and local laws,
• stopping use if uncertain,
• consulting a qualified professional when needed.

If you continue to use instructions, you do so at your own risk.

5. Special Waiver Action (Hide Disclaimer)

If you choose the in-app action "Hide disclaimer", you must separately confirm responsibility via an explicit waiver flow.

By accepting that waiver, you acknowledge and agree that:

• you requested to hide a key safety notice,
• you assume full responsibility for outcomes resulting from use of instructions,
• the Company provides the Service "as is" subject to these Terms.

5A. User-Edited Instruction Content

If you edit instruction text in the app and save those edits, that guide becomes user-modified content.

At the first saved text edit, the app requires a separate explicit waiver acceptance.

By accepting, you acknowledge and agree that:

• the instruction content was modified by you,
• responsibility for use of the edited instruction is fully yours,
• the Company is not responsible for outcomes resulting from your edits.

6. No Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by law, the Company and its affiliates, officers, employees, contractors, and licensors are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, profits, or goodwill, arising from or related to use of the Service.

Where law permits, the Company's aggregate liability is limited to the greater of:

• amounts paid by you to the Company in the 12 months before the claim, or
• USD 100.

8. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its affiliates from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of:

• your misuse of the Service,
• your violation of these Terms,
• your violation of law or third-party rights.

9. User Content and Inputs

You are responsible for content you provide (photos, text, corrections). You represent you have rights to submit such content and that it does not violate law or third-party rights.

10. Subscriptions and Billing

Premium features may include unlimited generation and export/share. Billing, renewals, cancellation, and refunds are handled by Apple App Store / Google Play under their platform rules.

11. Account, Suspension, Termination

We may suspend or terminate access if required for safety, legal compliance, abuse prevention, or system integrity. You may stop using the Service at any time.

12. Changes to Terms

We may update these Terms. If changes are material, we will require renewed in-app acceptance before continued use.

13. Governing Law and Disputes
